1、2023修订FIDIC白皮书（2017雇主一咨询工程师服务协议通用条件）2.1.2TheC1ientacceptsresponsibi1ityforandacknow1edgesthattheConsu1tantwi11re1yontheaccuracy,sufficiencyandconsistencyofa11theinformationprovidedbytheC1ientorbyothersonbeha1foftheC1ient.TheConsu1tantsha11usereasonab1eendeavourstoreviewa11significantinformationprovi

2、dedtoitbytheC1ientorbyothersonbeha1foftheC1ientwithinareasonab1etimeofreceipt.Totheextentachievab1eusingthestandardofcareinSub-C1ause3.3.1StandardofCareztheConsu1tantsha11reviewsuchinformationwithaviewtoensuringthatsuchinformationdoesnotcontainanymanifesterror,omissionorambiguityandsha11giveNoticeto

9、nsionontheProgramme/.工作完成时间应根据第4.4条延误进行变更，以反映暂停对计划的影响。6.3.5 TheConsu1tantsha11takereasonab1emeasurestomitigatetheeffectsofthesuspensionoftheServicesorpartthereof.6.3.6 咨询工程师应采取合理措施，以减轻全部或部分服务暂停的影响。注：增加以下新内容的第6.3.5条：6.3.7 TheConsu1tantsha11takereasonab1emeasurestomitigatetheeffectsofthesuspensionofth

10、eServicesorpartthereof/1.咨询工程师应采取合理的措施来减轻暂停服务或部分服务的影响。(e)WhereanExceptiona1Eventhas1edtoasuspensionoftheServicesformorethanonehundredandsixty-eight(168)daystheC1ientmayterminatetheAgreementupongivingfourteen(14)daysNoticetotheConsu1tant.注：第641(e)条：(1)第一行，删除WithoutprejudicetoSub-C1ause6.1.1Suspension

12、sameamount,suchastoinhibittheConsu1tantintheperformanceoftheServicesortoresu1tinfinancia1disadvantagetoit.(c)对咨询工程师从国外汇外币到国内用于当地货币支出，并随后将外币或当地货币重新汇国外的行为征收税款或不同的汇率，以至于妨碍顾问公司履行服务或导致其财务上的不利。ThentheC1ientagreesthatSuchcircumstancessha11bedeemedtojustifytheapp1icationofC1ause4.6Exceptiona1Eventifa1ternat

15、eyearafterthecomp1etionorterminationoftheServices,theC1ientmayzbyNoticeofnot1essthanfourteen(14)daystotheConsu1tantrequirethatanindependentreputab1efirmofprofessiona11yqua1ifiedaccountantsnominatedbyitauditanytimeandexpenserecordsc1aimedbytheConsu1tant.Theauditsha11beconductedbyattendingduringnorma1

16、workinghoursattheofficewheretherecordsarekeptandtheConsu1tantsha11afforda11reasonab1eassistancetotheauditors.Anysuchauditsha11beattheC1ientscost.7.6.4 除非协议规定为总价支付外，雇主在不迟于服务完成或服务终止后一年，可提前至少14天通知咨询工程师发，要求一家由其提名的独立的、信誉良好的、专业合格的会计公司来审计咨询工程师索要的任何时间和费用记录。审计工作应在正常工作时间内、在保存记录的办公室里进行，咨询工程师应向审计员提供一切合理的帮助。任何此类审计均由雇主承担费用。8.1iabi1ities第8条责任8.1 1iabi1ityforBreach违约责任8.1.1
