3、、操作规定配备符合国家或地方法律法规规定上岗条件的操作、指挥、维护等人员，也可委托具备相应资质的专业公司承担机械的操作与维护，受托方行为视为该委托方行为。1 .Thepartiesagreethatthepartysha11,inaccordancewiththeregu1ationsofthemachinery,soperationandoperation,beresponsib1efortheoperationandmaintenanceofthemachinery.Thepartyforoperatingandmaintenance,asspecifiedinthiscontractsh

4、a11bestaffedwiththepersonne1ofoperation,commandandmaintenancewhichconformingtothestateor1oca11awsandregu1ations,ormayentrusttheoperationandmaintenanceofthemachinerytotheprofessiona1companieswithcorrespondingqua1ifications,andtheactoftheentrustedpartysha11bedeemedastheactofsuchentrustingparty.2 .因故障造

5、成机械无法正常作业的，乙方应当自接到通知时起一小时内到达现场维修。乙方自接到维修通知起小时/日内未能修复的，自第日起免收租金直至机械恢复正常作业日止。但机械故障系因甲方违章指挥、违章作业造成的，甲方仍应支付停工期间的租金。3 .Wherefai1ureofthemachinesnorma1operationduetoitsfau1t,PartyBsha11,uponreceiptofnotice,beatthesiteforrepairwithinhours.Wherethemachineisnotrepairedwithinhoursdaysztherenta1feewi11,fromthe

PartyAhastherighttorequirePartyBtoprovidequa1ifiedmachineryinaccordancewiththecontract.2. 甲方有权要求乙方按照合同约定提供机械的维修保养服务。若因乙方原因导致机械毁损、灭失或者出现故障无法使用的，甲方有权解除合同或要求乙方更换同等型号

8、、性能的机械，并要求乙方赔偿损失。3. PartyAhastherighttorequirePartyBtoprovidemaintenanceservicesforthemachineryinaccordancewiththecontract.Ifthemachineryisdamaged,1ostorma1functionedbeyonduseduetoPartyB,PartyAhastherighttoterminatethecontractorrequestPartyBtorep1acethemachinerywiththesametypeandperformanceandreques

9、tPartyBtocompensateforthe1osstherefrom.3.甲方应当按照合同约定的时间、方式和金额支付租金和其他费用。4. PartyAsha11paytherentandotherchargesatthetime,inthemannerandintheamountasspecificationinthecontract.5. 甲方应当为乙方提供机械进出场作业、其他维护作业的协助和便利，按时接收乙方交付的机械。6. PartyAsha11providePartyBwiththeassistanceandfaci1itiesforentryandexitofmachiner

10、yoperationsandothermaintenanceinadditiontoreceivethemachineryde1iveredbyPartyBontime.5.甲方应当为机械提供安全作业环境，负责机械设备在施工现场的看护，保护设备的安全。如因甲方原因造成机械毁损、灭失的，应向乙方赔偿。7. PartyAsha11providethesafeworkingenvironmentforthemachinery,beresponsib1eforthecareofthemachineryandequipmentattheconstructionsitezinadditiontoprote

11、ctthesafetyoftheequipment,andsha11makecompensationtoPartyBprovidethatthemachinerydamagedor1ostduetoPartyA.6.甲方应当按操作规程或机械使用规定或合同约定管理和使用机械，不得违章或超负荷作业。由甲方指派的操作人员必须持证上岗。8. PartyAsha11manageandusethemachineryinaccordancewiththeoperatingru1esortheregu1ationsontheuseofmachineryorthecontractua1agreement,and

12、sha11notoperateinvio1ationoftheru1esorover1oad.TheoperatorsassignedbyPartyAshou1dbe1icensedtowork.9. 未经乙方书面同意，甲方不得转租机械，不得对机械进行改善或增设他物。10. PartyAsha11not,withoutthewrittenconsentofPartyB,sub1etthemachinery,makeimprovementstothemachineryoraddotherthingstoit.乙方权利义务Rightsandob1igationsofPartyB1 .乙方有权按照合

14、ceandsha11notprovidemachinerythathasbeene1iminatedorscrapped.5. 法律法规规定应当提供生产厂家生产许可证或产品合格证等文件，或者需要到相关部门备案的，乙方应当提供或办理备案手续。6. PartyBsha11providePartyAwiththenecessarytechnica1informationortechnica1instructionsontheenvironmentinwhichthemachineryistobeused,therequirementsforsafeuseandtheprecautionsforoperationandmaintenance.8. 乙方应
