3、基本情况及用途Artic1e1Basicconditionsanduseofco1dstorage1 .冷库的基本情况1. Basicconditionsofco1dstorage(1)冷库应保持完好、环境整洁，与有毒、有害污染源有效分隔；(1) Co1dstoragesha11bemaintainedingoodcondition,withac1eanandtidyenvironment,andeffective1yseparatedfromtoxicandharmfu1sourcesofpo11ution.(2)冷库地面应做到硬化，平坦防滑并易于清洁、消毒，并有适当的措施防止积水；(2)

4、Theco1dstoragef1oorshou1dbehardened,f1at,non-s1ipzeasytoc1eananddisinfect,withappropriatemeasurestopreventwateraccumu1ation.(3)冷库应有良好的通风、排气装置，保持空气清新无异味，避免日光直接照射；(3) Co1dstorageshou1dbeequippedwiththedevicesofgoodventi1ationandexhaustsothattokeeptheairfreshandodor1ess,inadditiontoavoiddirectsun1ight(

6、withtheco1dstoragesitep1an,1easetoPartyBthefo11owingco1dstoragefaci1itieswhichmeetthestorageconditionsforrefrigeratedandfrozenfood.2.甲方在日常管理中发现乙方在冷库租赁使用过程中存在以下情形的，应当及时向所在地市场监管部门报告，并有权予以制止：2.PartyA,wherefindsthefo11owingcircumstancesinthe1easeprocessoftheco1dstorageinthedai1ymanagement,sha11withoutan

7、yde1ayreporttothe1oca1marketsupervisionauthoritiesandreservetherighttostopit:(1)乙方无合法资质的；(1) Without1ega1qua1ificationbyPartyB;(2)贮存腐败变质或者感官性状异常的食品；(2) Storageoffoodthatisspoi1edorhasabnorma1organo1epticproperties.(3)贮存病死、毒死、死因不明或者来源不明的畜、禽、兽、水产动物肉类及其制品；(3) Storageofthe1ivestock,pou1try,veterinaryand

8、aquaticanima1meatandproductsthereofwhicharediseased,poisoned,ofunknowncauseofdeathorofunknownorigin.(4)贮存无标签的预包装食品；(4) Storageofun1abe11edprepackagedfood;(5)贮存国家为防病等特殊需要明令禁止生产经营的动物肉类及其制.口口,(5) Storageoftheanima1meatanditsproductsexpress1yprohibitedbytheStatefordiseasepreventionandotherspecia1needs;(

9、6)贮存其他不符合法律法规或者食品安全标准的食品。(6) Storageofotherfoodproductswhichfai1tocomp1ywith1awsandregu1ationsorfoodsafetystandards.3.甲方负责冷库设备、设施的管理和维护，具体包括：3. PartyAisresponsib1eforthemanagementandmaintenanceoftheco1dstorageequipmentandfaci1ities,inc1uding.(1)定期测定、记录冷库温度，并予以保存。(1) Thetemperaturesofco1dstorageshou1

10、dberegu1ar1ymeasured,recordedandkept.(2)定期消毒、除霜、清洁和维护冷库的冷藏冷冻设备、设施，保留相关校验、清洁、消毒、维护等记录，并承担费用。若因乙方原因造成冷藏冷冻设备、设施损坏，则由乙方负责维修或承担维修费用(自然损耗除外)；若无修复价值，由乙方折价赔偿。(2) Toregu1ar1ydisinfect,defrostzc1eanandmaintainco1dstoragerefrigerationandfreezingequipmentandfaci1ities,keeprecordsofre1evantca1ibrations,c1eaning,

11、disinfectionandmaintenance,andbearthecosts.PartyBsha11beresponsib1eforrepairingorbearingtherepaircostsfortheequipmentandfaci1itiesofrefrigeration&freezingwhicharedamagedduetoPartyB,Sreason(exceptfornatura1wearandtear);ifnorepairva1uethereof,PartyBsha11compensateatadiscount.第六条乙方的权利和义务Artic1e6PartyBs

12、rightsandob1igations1 .乙方在签订合同前，应当验看甲方的证照资质，确认其是否具有出租该冷库的权利，如有冷库备案要求，是否已经备案。1. PartyBshou1d,priortoconc1usionofthecontract,checkPartyAs1icensequa1ificationtoconfirmwhetherithastherighttorentouttheco1dstorage,andiftheco1dstorageshou1dbeputonrecordrequiredbythere1evantregu1ationswhetherPartyAhasdoneso

13、.2. 在租赁期间，若遇甲方转让冷库的部分或全部所有权，本合同对新所有权人继续生效。在同等受让条件下，乙方对本租赁物享有优先购买权。3. Duringthe1easeperiod,wherePartyAtransferspartora11oftheownershipoftheco1dstore,thiscontractsha11remainva1idforthesuccessorownerandPartyBsha11havethepreferentia1righttopurchasethe1easedpremisesunderthesameconditionsofassignment.3.乙方

14、应当分区、分架、分类存放冷藏冷冻食品。应当根据有关规定设置足够数量的存放架，其结构及位置能使贮存的冷藏冷冻食品离墙离地，保持规定距离，不得挤压食品；生食与熟食等容易交叉污染的食品应采取适当的分隔措施，固定存放位置并明确标识。4. PartyBsha11storerefrigeratedandfrozenfoodinseparatesections,she1vesandcategories.Thesufficientnumberofstorageracksshou1dbeprovidedinaccordancewiththere1evantregu1ations,withastructurean

15、d1ocationthatenab1esthestoredrefrigeratedandfrozenfoodtobekeptoffthewa11sandoffthef1oorataprescribeddistance,withoutsqueezingthefood;rawfoodandcookedfoodandotherfoodpronetocross-contaminationshou1dbeseparatedbyappropriatemeasures,fixedstorage1ocationsandc1ear1ymarked.5. 乙方冷藏冷冻食品堆码时，应当稳固且有空隙，便于空气流通，维

16、持贮存场所内温度的均匀性。6. PartyBsha11stackrefrigeratedandfrozenfoodsinthestab1emannerwithgapstofaci1itateaircircu1ationandmaintainuniformityoftemperatureinthestoragepremises.5.乙方贮存具有强烈挥发气味和相互影响的冷藏冷冻食品应及时告知甲方另设专库贮存，不得混放。7. PartyBsha11withoutanyde1ayinformPartyAtosetupaspecia1storageofthefrozenfoodwithstrongvo1ati1eodorandmutua1inf1uence,andsha11notbemi
