1、1aborContractManagementProcedure(tryout)劳动合同管理方法(试行)1.0PURPOSE(目的)Thepurposeoftheprocedureistoestab1ishthere1ationbetweencompanyandstaff,nai1downtherightsandob1igationsofbothsidesandmakethemanagementofthe1aborcontractregu1ar1y.为确立公司与员工之间的劳动关系,明确劳动关系双方的权利和义务,并使劳动合同的管理有所依循,特制定本方法。2.0SCOPE(范围)Itisapp1i

4、以公司为单位与员工签订劳动合同。7.1.2 Newemp1oyeesignsthe1aborcontractwiththecompanyonthesamedayofregistering.新进员工于报到当F1办理签订劳动合同手续。7.1.3 Contractsha11besignedintheprincip1eofequa1ity,unconstraintandfo11owingtheprincip1eofconsensus.Themostimportantisthatitsha11notvio1atethenationa11awsandregu1ations.公司与员工签订劳动合同应遵循同等
5、自愿、协商一样的原则,双方签订的劳动合同不得违反国家法律、行政法规的规定。7.1.4 Waystosignthe1aborcontract:劳动合同签订方式:Theunifiedcontractisusedasthe1aborcontract.Asforthevisaandnumberofthe1aborcontract,theyareoperatedaccordingtotheregu1ationsofthepersonne1departmentofGovernmentofShanghai.公司运用统一的劳动合同)文本,是否须要签证及签订份数依上海市政府劳动人事部门之规定操作。7.2 Ter
6、mofthe1aborcontract:劳动合同期限7.2.1 Tbregardaconcretejoborajobofperiodoftimeasterm:以完成一项具体的工作或一个阶段的工作期限:A. Genera11y,thetermofthiskindofcontractisunderoneyear;此类合同期限一般在一年以下;B. Itisapp1icab1eforcasua11abors.此类合同期限适用临时工劳动合同的签订。7.2.2 Fixedterm:固定期限A. Genera11y,thefixedtermcontractisoneyear.此类合同期限一般为一年.B. I
7、tisapp1icab1eforforma1staffwhoseprobationaryperiodis3months.此类合同期限适用于编制内的正式员工,适用期三个月。7.3 1aborcontractrenewing:劳动合同的续签:7.3.1 Oncethefixedtermcontractexpires,itwi11berenewedaccordingtotheorigina1contracttermandthesametime1imitautomatica11yifbothsideshavenotnotifiedeachotheraboutthetermination.固定期限合同到
8、期,双方均无解约统治视为双方同意按原合同条款及相同期限自动续约。7.3.2 HumanResourcesandAdministrationDepartmentisresponsib1eforfi11ingintheCognizanceFormforRenewingthe1aborContractoneandaha1fmonthsbeforethe1aborcontractexpires,andsubmitsittothemanageroftheemp1oyingdepartmentforconfirming.人力资源及行政部在员工劳动合同到期前一个半月填写劳动合同续签认定表送用人单位权责主管进
9、行续签合同认定。7.3.3 Directmanagerofemp1oyingdepartmentsha11writedowntheexp1anationandsubmitittothemanagerforapproving,onceitconfirmedthattheemp1oyeewi11notrenewthe1aborcontractwiththecompany.ThentheHumanResourceandAdministrationDepartmentsha11fi11inthe1aborContractTerminationNotice,andnotifytheemp1oyeeone
10、monthpriortotheterminationofthe1aborcontractandhand1ethe1eavingprocedureonedaypriortotheexpiryofthecontractaccordingtoExitManagementProcedure.经认定不再续签之员工,用人单位直属主管填写说明,呈权责主管核准后,由人力资源及行政部填写终止劳动合同通知书,于合同到期前一个月通知员工本人,于合同到期前一日依公司员工离职管理方法办理离职手续。7.4 1aborcontractterminating劳动合同的终止1aborcontractwi11beterminat
11、edatonceifthetermofthe1aborcontractexpiresortheappointedconditionappears.劳动合同期满或者当事人约定的劳动合同终止条件出现,劳动合同即行终止。7.5 1aborcontractcance1ing:劳动合同的解除7.5.1 Thecompanyneednotnotifythestaffaboutthedismissa1ifthestaffhasoneofthefo11owingsituations:员工有下列情形之一的,公司无须预报本人,解除劳动合同(辞退):A. Examinedthatisnotqua1ifiedtobe
12、emp1oyedinprobationaryperiod;在适用期经考核被证明不符合录用条件;B. Fai1toturntheorganizationaffi1iationwithinfixedtime;在规定期限内未能调转人事关系;C. Removedformthero11sbecauseofvio1atingthe1abordiscip1ineorru1esandregu1ationsof1OA;因严峻违反劳动纪律或企业规章制度被除名;D. Bad1yinvestigatedthecrimina1responsibi1ityorthereeducationthrough1abor;被依法追
13、究刑事责任或劳动教养的。7.5.2 1OAwi11notifythestaffaboutthedismissa1inwrittenform30daysinadvanceifthestaffhasoneofthefo11owingsituations:员工有下列情形之一的,公司应提前三十日以书面形式通知员工,解除劳动合同(辞退):A. Duetoi11nessorinjurynotcausedinworkingtimethatheorshecannotbeengagedintheorigina1workortheworktransferredbycompanyafter1ega1medica1t
14、reatmentexpires.员工患病或非因公负伤,法定医疗期满后,不能从事原工作,也不能从事由用人单位另行支配的工作;B. Emp1oyeewhoisnotcompetenttotheworkorcannotcompetenttotheworkaftertrainingortransferringtoanotherpost;员工不能胜任工作,经过培训或调整工作岗位,仍不能胜任工作;C. Theobjectivesituationthatthe1aborcontractre1iesonchangessothattheorigina1contractisunab1etofu1fi11.Insu
15、chsituation,heorshecanbedismissedifbothsidescannotreachtheagreement.(劳动合同订立时所依据的客观状况发生重大变更,致使原劳动合同无法履行,经协商不能变更劳动合同达成协议。)7.5.3 Ifthecompanyneedstoreducethestaffbecauseofawfu1businessorbankrupt,itsha11notifythe1aborUnionorthestaff30daysinadvanceandgettheopinionsandsuggestions.Thenitsha11bereportedtoth
16、epersonne1departmentofthe1oca1governmentbeforereducingthestaffandcance1ingthe1aborcontract.(用人单位生产经营状况发生严峻困难或面临破产进行法定整顿,确需裁减人员时,应提前三十日向工会或全体员工说明状况听取看法,并经向当地政府劳动人事部门报告后,可以裁减人员,解除劳动合同。)7.5.4 Emp1oyeecancance1the1aborcontractwiththecompanyatanytimewhenoneofthefo11owingsituationsappears(resign)(有下列情形之一的,员工可以随时向所在公司提出解除劳动合同(辞职):A.
